The below terms applies to Copier solutions with X-Corp Business Solutions

COST PER COPY TERMS & CONDITIONS SCHEDULE

This Schedule forms part of the Master Services and Equipment Rental Agreement ("Agreement") and is specifically tailored to the Managed IT Services offered by Almestar ("Service Provider"). This Schedule outlines the key service categories provided to the Customer and sets forth terms specific to each service category. Where any conflict exists between the Master Services and Equipment Rental Agreement terms and conditions and this Schedule, the provisions of this Schedule shall take precedence over the Master Services and Equipment Rental Agreement terms and conditions.

1. MAINTENANCE COVERAGE


1.1. X-Corp shall provide maintenance services during normal business hours as reasonably requested and necessitated by causes other than negligence, misuse, fire, water damage, accidents, power surges, or force majeure. Service requests related to power line and telephony infrastructure faults, damage to machine main boards, fax cards, print controllers, network cards, and hard drives are expressly excluded.


2. SOFTWARE ADJUSTMENTS


2.1. Charges may apply for software adjustments made 30 days after the equipment's installation.


3. PARTS AND CONSUMABLES


3.1. Throughout the contract's duration, X-Corp shall replace all photocopier parts, consumables, and facsimile parts. Items considered disposable, such as paper, and parts damaged due to negligence, misuse, or exceeding the manufacturer's maximum rated volume per month shall not be covered.


4. MONTHLY COPY VOLUME


4.1. If the monthly copy volume exceeds the manufacturer's maximum rated volume per month, additional charges may apply for parts usage beyond normal wear and tear. X-Corp may choose to either exclude the equipment from this agreement or repair it, recovering any additional expenses incurred.


5. EXCESS TONER USAGE


5.1. Colour copy charges are based on 30% page coverage, and black copy charges are based on 10% coverage. If the percentage coverage exceeds the specified limits, X-Corp may charge for excess toner usage accordingly.


6. MONTHLY VOLUME DISCREPANCY


6.1. If the equipment's monthly volume falls short of the customer's recommended monthly volume, X-Corp may charge monthly for the difference at the agreed copy charge.


7. AUTHORISED SERVICE AND SUPPLY USAGE


7.1. X-Corp’s service obligations under this Agreement shall apply strictly to equipment that has been maintained and serviced exclusively by X-Corp or its authorised representatives. Any service, repair, adjustment, or modification undertaken by unauthorised persons shall immediately void all warranties, service obligations, and liability on the part of X-Corp.


7.2. The Customer shall not permit any third party, including but not limited to internal staff or external contractors, to open, tamper with, or attempt to service the equipment without X-Corp’s prior written consent.


7.3. X-Corp shall not be responsible for any equipment malfunction, performance degradation, or failure attributable to:


  • 7.3.1. unauthorised service or interference with the equipment;
  • 7.3.2. the use of consumables, accessories, parts, or supplies not supplied or approved by X-Corp;
  • 7.3.3. installation or use of the equipment in a manner inconsistent with manufacturer specifications or operating guidelines.


7.4. In the event that unauthorised service or non-compliant consumables are found to have contributed to a fault or failure, X-Corp reserves the right to:


  • 7.4.1. recover the full costs of inspection, repair, and restoration of the equipment to working order;
  • 7.4.2. suspend service obligations under this Agreement pending rectification by the Customer;
  • 7.4.3. charge additional service fees for call-outs or technical support necessitated by such unauthorised activity.


7.5. X-Corp shall further not be held liable for any damages, direct or indirect, arising from the use of unauthorised supplies or service interventions.



8. SOFTWARE SUPPORT AND NETWORK FAULTS


8.1. Charges may apply for callouts related to software support or network faults, as per X-Corp's current rates.
